Introduction and Governing Law

These are the Terms and Conditions of Sale applicable to purchases from Discount Snowboards. The use of this site is governed by the policies, terms and conditions set forth below. Please read them carefully. Your use of this site indicates your acceptance of these terms and conditions.

These terms and the State and Federal laws of Victoria, Australia and The Commonwealth of Australia apply to all transactions for the purchase of products from Discount Snowboards, its web site at www.discountsnowboards.com.au and any associated web page (the "Site"). These terms represent the complete Agreement between Discount Snowboards and the Buyer covering the sale of Products from this Site.

Except for terms implied by applicable legislation, Discount Snowboards does not offer or agree to any conditions, warranties, guarantees or representations relating to the quality, description or performance characteristics of the Products other than those set out in these terms.

The Buyer's completion of the order form on this Site will constitute an offer to the Buyer to purchase Products (the "Order"). All Orders are subject to acceptance by Discount Snowboards. Your receipt of an electronic or other form of Order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Discount Snowboards reserves the right at any time after receipt of your order to accept or decline your order for any reason.

Liability

Discount Snowboards is not liable for any losses or damages caused by this website or any website linked to or from this website.

Prices

The prices to be paid by the Buyer for all Products will be Discount Snowboards' current selling price on the date of receipt by Discount Snowboards of the Order, less any applicable discounts in effect at that time. All Orders will attract a delivery charge as set out on the Delivery information page which can be viewed at: http://www.discountsnowboards.com.au/delivery.php

Discount Snowboards will not be responsible for errors in pricing that appear on the Site. Discount Snowboards will notify a Buyer in the event of a pricing error on the Site before an Order is delivered and the Buyer will have the opportunity to cancel its Order within a reasonable time. Discount Snowboards reserves the right to cancel unilaterally any Order based on a mistake in pricing within a reasonable time of receiving that Order.

Discount Snowboards reserves the right to change its prices from time to time without prior notice to the Buyer. For deliveries in Australia, all prices displayed in this website include Australian Goods and Services Tax (GST). For deliveries outside Australia, all prices displayed in this website do not include Australian Goods and Services Tax (GST).

"List price" is an estimate of the standard full price of the product, based on a standard industry mark-up. Products may never have actually been sold by Discount Snowboards at the "list price".

Stock Availability

If a Product is out of stock when Discount Snowboards processes an Order, Discount Snowboards will contact the Buyer to discuss revised delivery times or refund options. A refund option does not apply if a product is subsequently out of stock when requested by the customer as part of the product exchange.

Order Delivery

All Orders by the Buyer under this Agreement must be placed via the forms provided on this Site and must specify the information requested, including (but without limitation):
(a) Quantity and description of Products
(b) The full street address to which the Product is to be delivered
(c) Current billing address to which credit card statements are sent.
The Buyer must complete all information requested on the Order form before the Order is processed by Discount Snowboards.
Discount Snowboards will send the Buyer an e-mail acknowledging the Products ordered as soon as possible after the Buyer places an Order. If Discount Snowboards does not accept the Buyer's Order for any reason, it will inform the Buyer by email in the same manner.

Delivery times quoted in the Site are indicative only. Discount Snowboards will endeavor to deliver your order within the specified time. The Buyer acknowledges that Discount Snowboards may, from time to time, be subject to production, delivery or other unforeseen delays and that Discount Snowboards may allocate distribution of Products ordered among its customers at its sole discretion.

If no-one is available at the delivery address to receive the Products, Discount Snowboards' delivery agent will leave an "unable to deliver" card at the address and the Buyer should follow the directions on that card to obtain delivery of the Products. Discount Snowboards reserves the right to make partial delivery of an Order where multiple products have been ordered.

Payment

Credit card payment for Products purchased from Discount Snowboards via the Site can be made only by VISA or MasterCard credit cards.

Discount Snowboards will verify the credit card information submitted by the Buyer and will advise the Buyer that its Order has been accepted. The Buyer agrees to submit to Discount Snowboards such information as may be reasonably requested by Discount Snowboards for the authorization and verification of its credit card purchases.

Discount Snowboards reserves the right to conduct payment verification tests to ensure legitimate use and ownership of a credit card by the Buyer. This includes processing an additional nominal charge to a Buyer's credit card that subsequently be refunded.

Discount Snowboards reserves the right to exercise its lawful remedies if a dispute arises over payment through the Buyer's credit card provider. In particular, but without limitation, if the Buyer's credit card provider rejects a payment when due, Discount Snowboards at its discretion may delay or cancel delivery of Orders placed by the Buyer.

Discount Snowboards may also offset and deduct from any refund due to the Buyer all sums owed by the Buyer to Discount Snowboards. If the Buyer's account is placed in collection, Discount Snowboards will be entitled to claim all reasonable expenses for collection, including legal fees incurred in connection therewith.

Payment by Direct Bank Deposit must be confirmed in Discount Snowboards bank account before goods will be shipped.

Lay-by Orders

A minimum transaction of $100. Sale items may be placed on lay-by unless otherwise stated in product description. An initial payment equaling a minimum of 1/3 of the total is required when order is placed. Lay-by must be finalised within 90 days of initial order. If the lay-by is cancelled by the customer within the lay-by period then all monies will be refunded minus a termination fee equal to 1/3 of the total order, with a minimum of $100. If the customer fails to make payments and/or do not finalise the lay-by by the due date (without contacting us to arrange an extension), the lay-by will be cancelled, stock will be returned to the store and a termination fee equal to 1/3 of the total order, with a minimum of $100, will apply to cover costs. Individual items will not be separated from a lay-by until final payment has been received. It is the customer's responsibility to keep track of payments made and when remaining payment is to be completed by. Once the order is dispatched, the normal Refund/Exchange policy applies. All items remain the property of Discount Snowboards until final payment has been received.

Product Returns and Exchanges

Discount Snowboards will offer exchange of a product if returned by the Buyer within 14 days of receipt. Product exchanges are limited to available stock on hand and Discount Snowboards will not be liable where a product a customer wishes to exchange their item for is no longer in stock. Discount Snowboards will not provide refunds for product returns other than in circumstances where required by Australian State and Federal Law.

The Buyer is responsible for return shipping arrangements and for all shipping costs between Discount Snowboards and the Buyer for any items to be returned to Discount Snowboards for exchange or for a warranty claim.

Cancelling an Order

Once an order has been received, Discount Snowboards' normal exchange policy will apply should a customer wish to cancel or amend the order.

Freight Methods

Discount Snowboards will arrange delivery of all Products to the Customer using a delivery method/carrier as selected by Discount Snowboards. A Buyer must not arrange its own courier to collect the Products from Discount Snowboards unless agreed in writing.

Products Damaged in Transit

Claims for alleged damage to Products caused in transit from Discount Snowboards to the destination specified by the Buyer must be notified to Discount Snowboards within 24 hours of receipt of delivery and the consignment note must be marked as "Received Damaged".

The Buyer must contact Discount Snowboards by e-mail to info@discountsnowboards.com.au and obtain return instructions. The Buyer must also supply a copy of the consignment note to Discount Snowboards. Discount Snowboards will contact the Buyer to arrange a suitable remedy.

Delivery Outside Australia

Buyer is responsible for all local duties and taxes. Buyer is recommended to contact their local Customs office to check the cost of any local duties and taxes prior to ordering.

If for any reason duties, taxes and other fees are not paid by the customer resulting in a charge to Discount Snowboards by the shipping company, Discount Snowboards will charge the customer's account for these fees.

Marketing Communications

By ordering from Discount Snowboards you grant us the right to add your contact details to our database. From time to time we may contact you about offers and new products. You can easily be removed by either unsubscribing via a link in our marketing e-mails, or contacting our Customer Service at info@discountsnowboards.com.au and we will remove you from marketing communications.

Product Warranties

All products are covered by specific manufacturer's warranty and their accompanying terms and conditions. Please refer to the manufacturer's website for their specific warranty conditions.

Amendment of Terms and Conditions

Discount Snowboards may revise these terms and conditions from time to time. Buyers should therefore periodically visit this page to familiarise themselves with any such revisions.
